Eric Benet isn’t going quietly into the night now that he and Halle Berry are divorcing.
In a June 1 Los Angeles Superior Court filing (a copy of which has been obtained by the Smoking Gun Web site) Benet asks that the court “determine the validity and/or enforceability of the parties’ prenuptial agreement” and the subsequent amendments that they made to it.
On top of that, the papers state, Benet – who split from the Monster’s Ball Oscar winner last October (divorce papers were filed by Berry in April) – is seeking spousal support as well as reimbursement of his legal bills.
There has been no comment from Berry’s camp, but last week the actress made news by telling Oprah Winfrey that she will “never, never” marry again.
Upon announcing her separation last fall, Berry said in a statement: “Eric and I have had marital problems for some time now and have tried to work things out together.
“However, at this point, I feel we need time apart to reevaluate our union. We ask that you respect our privacy as we are going through this emotional time,” she added.
Berry was previously married to pro ballplayer David Justice, but the relationship ended in 1996. The instability in her relationship with Benet has been well documented, and at one point her husband was reportedly treated for a sex addiction.
Benet also has a young daughter, India, from a previous relationship with a girlfriend who was killed in a car crash 15 months after the girl was born.
Berry and Benet, both 37, reportedly met in 1999 at a party to celebrate the premiere of Berry’s HBO movie Introducing Dorothy Dandridge. His debut album, True to Myself, was released in 1996. His hits include “Spend My Life With You” and “Love Don’t Love Me.”
