A lawyer for Sean “Diddy says the club fight involving the hip-hop mogul in the early hours of Saturday morning has been blown out of proportion, and that it was not a criminal act.
“We are hopeful that this matter will be resolved without the filing of any criminal charges, as this was a disagreement among acquaintances, not a criminal assault,” the attorney, Benjamin Brafman, said in a statement.
Combs, 37, got into a shouting match with clubgoer Steven Acevedo, 31, at the New York City night spot Kiosk early Saturday, then punched him twice and knocked him to the ground, according to the New York Daily News.
The News and other media outlets reported that Combs was expected to surrender to police on Tuesday to face assault charges, but Brafman denied that.
“What is being reported in the media is inaccurate,” Brafman said. “Mr. Combs is not going to be arrested today.”
Another source agreed: “Sean isn’t being arrested, and he’s not going into the NYPD precinct today.”
Acevedo and his lawyer both declined to comment to the News on Monday.
The source told PEOPLE that Combs and Acevedo, who works in the clothing business in Manhattan, have known each other for more than 10 years: “They travel in the same circles, go to the same clubs, et cetera. They’re not really friends, but they’re acquaintances.”
The reported dispute was allegedly over a woman, but the source claimed that was not true. “This wasn’t over a girl. I’m not sure what the disagreement was over, but I’m told it definitely wasn’t over a girl.”
Combs was spotted out on the town again on Monday night, at Butter, where he partied with Jay-Z and John Mayer. Acevedo, according to TMZ.com, was spotted leaving the club within ten minutes of Combs.
